Service Overview

Welcome to WRISTORIAN®. The terms "we", "us" and "our" refer to WRISTORIAN. We operate this store and website - including all related information, content, features, tools, products, and services - to provide you with a curated shopping experience (the "Services"). WRISTORIAN is powered by Shopify.

These Terms of Service ("Terms") together with any policies referenced herein describe your rights and responsibilities when you use the Services. Please read carefully, as they include important information about your legal rights and cover areas such as disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy (see link below). If you do not agree to these Terms or the Privacy Policy, you should not use or access the Services.

Payment & Category Notes

Categories. WRISTORIAN offers (i) Vintage Patek Philippe (historical, one-of-a-kind pieces) and (ii) Créations Originales (our contemporary line).

Bank wire Over USD 2,500. Orders above USD 2,500 must be paid by bank wire transfer. Wire instructions are provided at order confirmation. Shipment occurs only after cleared funds. Bank fees are the client's responsibility.

Card Threshold. Cards are accepted up to USD 2,500.

KYC & Fraud. For high-value orders, we may request identity/verification and reserve the right to cancel any order pending verification or payment issues.

Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own or manage.

To use the Services (including browsing or purchasing), you may be asked to provide certain information (email, billing, payment, shipping). You represent that all information you provide is correct, current, and complete and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

Our Products

We aim to represent our products faithfully. However, color and appearance can vary by device and settings. We do not warrant that the appearance or quality of any product or service will meet your expectations or be identical to on-screen depictions.

Descriptions are subject to change at any time without notice. We may discontinue products and may limit quantities offered to any person, region, or jurisdiction.

Orders

When you place an order, you make an offer to purchase. WRISTORIAN may accept or decline any order at our discretion. We must receive and process your payment before acceptance. We will attempt to notify you of any changes or cancellations using the contact details provided with your order.

Order Acceptance & Availability. Many vintage listings are singular; availability is not guaranteed until we expressly accept and payment clears. We may cancel or decline orders that cannot be fulfilled or verified.

Your purchases are subject to our Refund & Return Policy (see link below). You represent that your purchases are for personal or household use, not for commercial resale or export.

Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged will be the price in effect at the time of order (see your confirmation email). Prices generally exclude taxes, shipping, handling, customs, and import charges unless otherwise stated.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases, and to promptly update payment details and contact info.

Wire Timing. For bank wire payments, please initiate payment within 3 business days of invoice. If funds are not received timely, we may cancel and release the piece. Currency conversion and bank fees are borne by the client.

Shipping and Delivery

Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you upon transfer to the carrier.

Method & Insurance. Shipments dispatch via insured FedEx courier with adult signature required. Typical timelines: US 1–5 business days; International 2–7 business days (subject to customs). Parcels are insured for declared value until delivery scan. See our Shipping Policy (link below) for details.

Customs, Duties & Taxes (International)

Recipients are responsible for any import duties, VAT/GST, or brokerage fees imposed by local authorities. We declare accurate values and provide required documentation.

Intellectual Property

All trademarks, brands, text, images, graphics, video, audio, and the design/arrangement thereof on the Services are owned by WRISTORIAN, its affiliates, or licensors and are protected by applicable laws. Use is permitted only for personal, non-commercial purposes unless otherwise authorized in writing. All rights not expressly granted are reserved.

Optional Tools

Third-party tools accessible through the Services are provided "as is" and "as available," without warranties or endorsements. Use is at your own risk and subject to the third party's terms.

Links to third-party sites or materials are provided for convenience only. We do not control and are not responsible for their content, policies, or practices. Access at your own risk.

Relationship with Shopify

WRISTORIAN is powered by Shopify to provide the Services. However, any sales and purchases are made directly with WRISTORIAN. Shopify is not responsible for your transactions with WRISTORIAN, and you expressly release Shopify from claims arising from such transactions.

Privacy Policy

Personal information collected through the Services is subject to our Privacy Policy and may also be processed by Shopify to operate and improve the Services. By using the Services, you acknowledge these privacy policies.

Feedback

If you submit ideas, suggestions, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use and display such Feedback in any medium. From time to time the Services may contain errors or omissions (e.g., in product descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct, update, or cancel orders where information is inaccurate, without prior notice.

You may not use the Services for unlawful purposes or to violate laws; infringe IP rights; harass, defame, or harm others; transmit malware or spam; scrape or crawl; or circumvent security. We may suspend or terminate access for violations.

Termination

We may terminate access to the Services at any time without notice, and you remain liable for amounts due through the termination date. Provisions that by nature should survive termination do so, including IP, Disclaimers, Limitation of Liability, Indemnification, Severability, Governing Law, and others.

Disclaimer of Warranties

Except as expressly stated by WRISTORIAN, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness, and non-infringement. Some jurisdictions do not allow certain disclaimers; those limitations may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, WRISTORIAN and our affiliates, officers, employees, agents, contractors, service providers, and licensors (and Shopify and its affiliates) shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, savings, data, or replacement costs, arising from or related to your use of the Services or products.

Indemnification

You agree to indemnify and hold harmless WRISTORIAN, Shopify, and our respective affiliates and representatives from claims, losses, liabilities, damages, and costs (including reasonable attorneys' fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.

Severability

If any provision is unlawful or unenforceable, the remainder remains in full force and effect.

Waiver; Entire Agreement

Our failure to enforce any right is not a waiver. These Terms (with referenced policies) constitute the entire agreement regarding the Services and supersede prior understandings.

Assignment

You may not assign these Terms without our prior written consent. We may assign without notice.

Governing Law

These Terms and any transactions are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Venue and jurisdiction shall lie exclusively in the state or federal courts located in Broward County, Florida. You and WRISTORIAN consent to such jurisdiction and venue.

Changes to Terms

We may update these Terms by posting changes on this page. Material changes will be notified as required by law. Your continued use of the Services after changes take effect constitutes acceptance.
